("SiteIn72", "we", "us", "our")

2. Agreement to These Terms

By purchasing, subscribing, requesting work, or using the SiteIn72 website/services (the "Service"), you ("Client", "you") agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

You confirm you have the authority to enter into these Terms on behalf of your business.

3. The Service (Single Offer)

SiteIn72 provides website creation + hosting/maintenance under one package:

What's included

Unless we agree otherwise in writing, the package includes:

• A new website delivered within 72 hours (see Section 6 for how the 72 hours is calculated)
• Up to 5 pages (typical: Home, Services, About, Contact, Service Area/Locations) or a single-page site when appropriate
• Mobile-first responsive layout
• Basic on-page SEO setup (page titles/meta, headings, image alt text, local keywords provided by you)
• Click-to-call button (if a phone number is provided) + contact form
• Hosting + SSL (included while subscription is active)
• Monthly maintenance (see Section 9)

What's not included

Not included unless quoted separately in writing:

• Paid ads management (Google/Meta), ad creatives, tracking setups beyond basics
• Ongoing SEO campaigns (link building, citations, content marketing), or guaranteed rankings
• Custom web apps, portals, memberships, complex integrations
• Advanced booking systems (beyond embedding/adding a link), CRM builds, automation systems
• Extensive copywriting/branding/logo creation
• Photography/videography or paid stock assets (unless you provide licenses)

4. "No Meetings" & Communication

SiteIn72 is designed to be asynchronous. We do not require video meetings. Communication is typically via email and forms. If we agree to a call in a special case, it is optional and does not change the scope, price, or timeline unless agreed in writing.

5. Client Responsibilities (What We Need From You)

To deliver your website, you agree to provide accurate and complete:

• business name, address, phone, email
• services list and service area (cities/regions)
• logo/brand assets (if available)
• text/copy you want included (or approval for us to use simple placeholder copy)
• images you own or have permission to use
• any required legal disclaimers specific to your industry (if applicable)
• access to your domain/DNS (if you already own a domain)

Delays caused by missing information, late replies, or missing approvals pause the delivery timeline.

6. 72-Hour Delivery Promise (How It Works)

"72 hours" means 72 business hours (Monday–Friday, excluding public holidays in Romania), starting when all of the following are true:

• The $299 setup fee is paid/confirmed, and
• You have submitted the required intake info + assets, and
• We confirm we have everything needed to begin.

If the project is delayed because you did not supply required materials or approvals, we will resume work when those are received.

7. Revisions

The setup fee includes:

• 1 revision round, submitted as one consolidated list, within 7 days of first delivery.

Requests beyond this (or major changes) may be:

• completed using your monthly maintenance minutes (if small enough), or
• quoted separately.

8. Monthly Subscription: Hosting + Maintenance

Your $99/month subscription includes hosting, SSL, basic upkeep, and a fair-use maintenance allowance.

Maintenance "fair use"

Includes up to 30 minutes/month of small changes, such as:

• text updates, swapping images, small layout adjustments
• updating hours, phone number, service list
• small edits to existing pages

Not included under fair use:

• new pages, new features, major redesigns
• complex integrations, app-like functionality
• heavy copywriting or large content migrations

Unused minutes do not roll over.

9. Payments, Renewal & Cancellation

Setup fee ($299)

The setup fee is billed once and is required before we start work.

Subscription ($99/month)

The subscription is billed monthly in advance and automatically renews unless canceled.

Payment processor

Payments are processed via PayPal (invoicing and/or subscription). We may receive payment confirmations and billing status but we do not store full card details.

How to cancel

You can cancel anytime by:

• canceling the PayPal subscription in your PayPal account, and/or
• emailing info@sitein72.com with subject: "Cancel subscription"

Cancellation becomes effective at the end of the current paid billing period.

Failed payments / non-payment

If a payment fails, we may:

• retry the charge,
• notify you,
• suspend hosting after 7 days overdue,
• remove hosted content after 30 days overdue (unless prohibited by law or otherwise agreed in writing).

10. Refund Policy

Setup fee refunds

Full refund of the $299 setup fee if you cancel before work begins.

Once work begins, the setup fee is non-refundable, because time and production work are committed.

"Work begins" when we start building, customizing, or implementing your site based on your intake/materials.

Subscription refunds

Monthly subscription charges are non-refundable once billed, except where required by law.

11. Ownership & Licenses

Your materials

You retain ownership of materials you provide (logos, text, photos). You grant us a license to use them to deliver the Service.

Website deliverables

Upon receipt of all amounts due, you own the website content/design as delivered to you, except for:

• third-party libraries/tools/fonts that remain subject to their respective licenses.

You are responsible for ensuring you have rights/licenses to any content you provide.

12. Portfolio Use

Unless you request confidentiality in writing, you grant us permission to display your website (and your business name/logo) in our portfolio and marketing materials.

13. Acceptable Use

You may not use the Service or hosted website for illegal, infringing, deceptive, or harmful activities (including malware, phishing, or unlawful content). We may suspend service if we reasonably believe there is a violation.

14. Third-Party Services

Hosting, email delivery, analytics, and other infrastructure may be provided by third-party vendors. Their availability and policies may affect the Service. We are not responsible for outages caused by third-party providers, but we will take reasonable steps to restore service.

15. Disclaimers

The Service is provided "as is" and "as available". We do not guarantee:

• a specific number of leads, sales, or conversions,
• specific search rankings or SEO outcomes,
• uninterrupted uptime (although we aim for reliable availability).

16. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim is limited to the amounts you paid to us in the last 3 months, or $299, whichever is greater.

17. Indemnification

You agree to indemnify and hold harmless Amortoae Petru PFA from claims arising from:

• your content/materials,
• your business practices,
• your use of the website,
• violation of law or third-party rights.

18. Termination

We may suspend or terminate the Service if you:

• materially breach these Terms,
• fail to pay after notice and grace periods,
• use the Service unlawfully.

19. Governing Law & Disputes

These Terms are governed by the laws of Romania, unless mandatory consumer/business protections require otherwise.

Any disputes will be handled by the competent courts in Romania, unless we both agree in writing to an alternative process.

20. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will change. Continued use of the Service after changes means you accept the updated Terms.
